First Appellate Authority

The Right to Information Act, 2005 directs every public authority to appoint an appellate authority under sub-section (1) of Section 19. The Appellate Authority shall be an officer who is senior in rank to the State Public Information Officer as per the provision of the RTI Act. The Competent Authority in discharge of its duty under sub-section (1) of Section 19 of the RTI Act, has appointed Dr. Pawan Kumar, Assistant Professor-cum-Nodal Officer (Legal) as First Appellate Authority. First Appeal under section 19 (1) of the RTI may be preferred (1) when any person does not receive decision of the State Public Information Officer under sub-section (1) and clause (a) of sub-section (3) of Section 7 of the RTI Act; (2) when a person is aggrieved by the decision of the State Public Information Officer. Such appeal may be preferred within thirty days from the expiry of time specified for receiving a decision or receipt of a decision of the State Public Information Officer although the First Appellate Authority may admit the appeal after expiry of the period of thirty days if he is satisfied that the appellant was prevented by sufficient cause from filing the appeal in time. Further, first appeal may also be filed by third party under Section 19 (2) of the RTI Act.

Any person aggrieved by decision of the First Appellate Authority may file appeal before Hon’ble State Information Commission as per provisions of the RTI Act within stipulated time period.
